The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 20, 2024 SPR24/2542; SPR24/2545 Stacy Book Records Access Officer Massachusetts Parole Board 12 Mercer Road Natick, MA 01760 Dear Ms. Book: I have received the petitions of Timothy Duguay appealing the nonresponse of the Massachusetts Parole Board (Board) to two requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 19, 2024, in two separate requests, Mr. Duguay requested “any and all written recommendations from the Attorney General, the Commissioner of Corrections, the Chief of the Wareham Police Department, and the Plymouth County District Attorney’s Office that may have been submitted in response to [specified pardon and commutation petitions].” Claiming to not yet have received responsive records, Mr. Duguay petitioned this office and these appeals, SPR24/2542 and SPR24/2545, were opened as a result. Subsequently, I learned that the Board provided Mr. Duguay with a response dated September 5, 2024. Where these appeals were opened as a result of the Board’s lack of a written response, I will now consider these administrative appeals closed. Mr. Duguay may appeal the substantive nature of the Board’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
