See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 19, 2024, in two separate requests, Mr. Duguay requested “any and all written recommendations from the Attorney General, the Commissioner of Corrections, the Chief of the Wareham Police Department, and the Plymouth County District Attorney’s Office that may have been submitted in response to [specified pardon and commutation petitions].” Claiming to not yet have received responsive records, Mr. Duguay petitioned this office and these appeals, SPR24/2542 and SPR24/2545, were opened as a result. Subsequently, I learned that the Board provided Mr. Duguay with a response dated September 5, 2024. Where these appeals were opened as a result of the Board’s lack of a written response, I will now consider these administrative appeals closed. Mr. Duguay may appeal the substantive nature of the Board’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
