The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 2, 2024 SPR24/2615 Michael Cunningham, Esq. Town Counsel Town of Arlington 50 Pleasant Street Arlington, MA 02476 Dear Attorney Cunningham: I have received the petition of Christopher Loreti appealing the response of the Town of Arlington (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 27, 2024, Mr. Loreti requested the following: [1] [P]ortion of the revised meeting minutes of the Town Manager Screening Committee for February 7, 2023 showing the name of the four finalists for the position of Town Manager and the results of the vote or votes taken to select them as finalists. [2] The resumes of the four finalists provided to the Screening Committee for the Town Manager position[.] Previous Appeal This request was the subject of a previous appeal. See SPR24/1784 Determination of the Supervisor of Records (June 25, 2024). In my June 25th Determination, I learned that the Town provided Mr. Loreti with a response on June 20, 2024. Unsatisfied with the Town’s response, Mr. Loreti petitioned this office and this appeal, SPR24/2615, was opened as a result. It is my understanding that the Town intends on providing a further response to Mr. Loreti. Accordingly, the Town is ordered to provide Mr. Loreti with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Loreti may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
