The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 24, 2024 SPR24/2644 Malav Patel, Esq. Middlesex County Sheriff’s Office 400 Mystic Avenue Medford, MA 02155 Dear Attorney Patel: I have received the petition of Leah Allen appealing the nonresponse of the Middlesex County Sheriff’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 5, 2024, Ms. Allen requested the following: [1] Amendments to the Securus Technologies contract related to phone rates since December 1, 2023 when calls were made free. [2] Any documents containing information on video calls, if any, including rates and call durations, as well as documents containing the same information on tablets, if any…both the monthly rental amount, as well as any charges for using various tablet features. [3] Any documents showing rates for electronic messaging, if that service is available. Claiming to not yet have received responsive records, Ms. Allen petitioned this office and this appeal, SPR24/2644, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Ms. Allen with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Allen may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
