Box 807 Middleton, MA 01949 Dear Ms. Grosky: I have received the petition of Leah Allen appealing the nonresponse of the Essex County Sheriff’s Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 5, 2024, Ms. Allen requested, [1] …documents containing current inmate calling service (ICS) provider minute phone rates… [2] Any amendments to the current contract including rates, since May 1, 2022… [3] Any documents containing information on video visitation, if any, including rates, revenues, and commissions, as well as documents containing the same information on tablets and electronic messaging, if any. Claiming to not yet have received responsive records, Ms. Allen petitioned this office and this appeal, SPR24/2645, was opened as a result. Subsequently, I learned that the Department provided Ms. Allen with a response dated September 26, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Allen may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
