The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 26, 2024 SPR24/2647 Berky Gray Paralegal Suffolk County Sheriff’s Department 200 Nashua Street Boston, MA 02114 Dear Ms. Gray: I have received the petition of Leah Allen appealing the nonresponse of the Suffolk County Sheriff’s Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 5, 2024, Ms. Allen requested “…documents containing inmate calling service (ICS) provider per minute phone calling rates, video calling, and electronic messages rates. Please include in your response the current contract and any amendments since January 1, 2021. If you do not have a current signed contract or amendment, please let me know what the rates are.” Claiming to not yet have received responsive records, Ms. Allen petitioned this office and this appeal, SPR24/2647, was opened as a result. Subsequently, I learned that the Department provided Ms. Allen with a response dated September 18, 2024, and intends to provide a supplemental response. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Allen may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
