Associate General Counsel Executive Office of Energy and Environmental Affairs 100 Cambridge Street, Suite 900 Boston, MA 02114 Dear Attorney Choi: I have received the petition of Malden News Network (“requestor”) appealing the response of the Executive Office of Energy and Environmental Affairs (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 12, 2024, the requestor requested, “all public records created or received in the area of public records custodial care, by any public official working in any capacity involving the EEA and the City of Malden. More specifically, the focus of this request is for records and timeframes related to a $3.5M award issued through the Gateway City Parks program or a separate $2.998M MVP grant.” The Office responded on September 4, 2024. Unsatisfied with the response, the requestor petitioned this office and this appeal, SPR24/2673, was opened as a result. Subsequently, I learned that the Office provided the requestor with a further response on September 25, 2024. Where this appeal was opened as a result of the Office’s September 4th response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Office’s September 25th response within ninety (90) days. See 950 C.M.R. 32.08(1).
