See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 11, 2024, Dr. McCarter requested police records pertaining to an assault of an identified patient on August 20, 1985. On July 11, 2024, the Department acknowledged the request, and provided a response on August 7, 2024. Unsatisfied with the Department’s August 7th response, Attorney Newbill petitioned this office on September 23, 2024, and this appeal was opened as a result. Subsequent to the opening of this appeal, I learned that on September 30, 2024, the Department provided Attorney Newbill with a response. Accordingly, where this appeal was opened as a result of the Department’s August 7th response, I will consider this administrative appeal closed. Attorney Newbill may appeal the substantive nature of the Department’s September 30th response within ninety days. See 950 C.M.R. 32.08(1).
