General Counsel Boston Housing Authority 52 Chauncey Street Boston, MA 02111 Dear Attorney Papademetriou: I have received the petition of Elizabet Gassmann appealing the nonresponse of the Boston Housing Authority (Authority/BHA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 22, 2024, Ms. Gassmann requested a copy of the following forms: [1] BHA Fiscal Year 2023 Federal Form 990; [2] BHA Year 2023 Financial Report to the Massachusetts Secretary of the Commonwealth; [3] Most Recent 2024 BHA Record of Percentage of [identified] Lease Signatories Under the Age of 62; [4] Most Recent 2024 BHA Record of Total Number of Lease Signatories at [an identified location]; [5] Most Recent 2024 BHA Record of Number of Apartments at [identified location] Not Under Lease. Claiming to not yet have received responsive records, Ms. Gassmann petitioned this office and this appeal, SPR24/2693, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Authority has provided a response. Accordingly, the Authority is ordered to provide Ms. Gassmann with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Gassmann may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
