The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 4, 2024 SPR24/2695 Officer John Barnes, Jr. Records Access Officer New Bedford Police Department 871 Rockdale Avenue New Bedford, MA 02740 Dear Officer Barnes: I have received the petition of Mitchell Kosht, Esq. appealing the response of the New Bedford Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 10, 2024, Attorney Kosht requested: [1] All investigatory reports, summary memoranda, witness statements, or other internal documents related to the sustained internal affairs complaint(s) against [a named individual] for an incident occurring on or about March 3, 2020… [2] All investigatory reports, summary memoranda, witness statements, or other internal documents related to the sustained internal affairs complaint(s) against [a named individual] for an incident occurring on or about October 19, 2022… The Department provided a response on September 25, 2024. Unsatisfied with the Department’s response, Attorney Kosht petitioned this office and this appeal, SPR24/2695, was opened as a result. Subsequently, the Department provided a supplemental response on October 2, 2024. Where this appeal was opened as a result of the Department’s September 25th response, I will now consider this administrative appeal closed. Attorney Kosht may appeal the substantive nature of the Department’s October 2nd response within ninety days. See 950 C.M.R. 32.08(1).
