Director of Public Records City of Boston 1 City Hall Square, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Tremayne Ellison appealing the response of the Boston Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 15, 2024, Mr. Ellison requested “[a]udio recordings of 911 calls for assistance by both [him]self and the suspect…” Previous Appeal This request was the subject of a previous appeal. See SPR24/1507 Determination of the Supervisor of Records (June 3, 2024). In my June 3rd determination, I found that it was unclear how the records could be withheld under Exemption (a) of the Public Records Law. The Department provided a response on July 3, 2024. Unsatisfied with the Department’s response, Mr. Ellison petitioned this office and this appeal, SPR24/2729, was opened as a result. Subsequently, the Department provided a supplemental response on October 2, 2024. Where this appeal was opened as a result of the Department’s July 3rd response, I will now consider this administrative appeal closed. Mr. Ellison may appeal the substantive nature of the Department’s October 2nd response within ninety days. See 950 C.M.R. 32.08(1).
