The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 10, 2024 SPR24/2731 Cynthia D. Mahr Superintendent for Finance and Operations Wellesley Public Schools 40 Kingsbury Street Wellesley, MA 02481 Dear Ms. Mahr: I have received the petition of Public Records Requestor (requestor) appealing the response of the Town of Wellesley (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 15, 2024, the requestor sought the following “de-identified” information: [1] Number of WPS students on 504 Plans by grade; [2] Number of students on IEPs by grade; [3] Number of students in specialized programs broken down by program and school; [4] Number of students in learning centers by school; [5] Number of students entering into initial IEPs by grade; [6] Number of students entering into initial 504 Plans by grade. Previous Appeal This request was the subject of a previous appeal. See SPR24/2715 Determination of the Supervisor of Records (October 1, 2024). In my October 1st determination, I closed the appeal after the Town provided a further response to the requestor on September 30, 2024. Unsatisfied with the September 30, 2024 response, the requestor petitioned this office and this appeal, SPR24/2731, was opened as a result. Subsequently, I learned that the Town provided a further response to the requestor on October 4, 2024. Where this appeal was opened as a result of the Town’s September 30th response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Town’s October 4th response within ninety (90) days. See 950 C.M.R. 32.08(1).
