The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 11, 2024 SPR24/2745 Lieutenant Gil Rojas Lowell Police Department 50 Arcand Drive Lowell, MA 01852 Dear Lieutenant Rojas: I have received the petition of Todd Wallack, of WBUR, appealing the nonresponse of the Lowell Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 3, 2024, Mr. Wallack requested, “[a]ny complaints filed with the department over the way the department or an individual officer handled a case or report involving sexual assault, including indecent assault, rape and attempted rape since Jan. 1, 2018.” On May 17, 2024, the Department acknowledged receipt of the request. On September 16, 2024, Mr. Wallack renewed his request with the Department. Claiming to not yet have received responsive records, Mr. Wallack petitioned this office and this appeal, SPR24/2745, was opened as a result. Subsequently, I learned that the Department provided Mr. Wallack with a response on October 10, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Wallack may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
