The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 18, 2024 SPR24/2746 Seah Levy Public Records Access Officer City of Cambridge 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of David Calhoun appealing the response of the City of Cambridge (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 27, 2024, Mr. Calhoun requested, “... all emails sent or received by [an identified] Water Department employee for the time period June 20, 2023 to June 27, 2023.” Prior Appeals This request was the subject of prior appeals. See SPR24/2109 Determination of the Supervisor of Records (August 6, 2024) and SPR24/2564 Determination of the Supervisor of Records (September 24, 2024). In my September 24th determination, I learned that the City provided a further response to Mr. Calhoun on September 24, 2024. Unsatisfied with the response, Mr. Calhoun petitioned this office and this appeal, SPR24/2746, was opened as a result. It is my understanding that the City intends on providing a further response to Mr. Calhoun. Accordingly, the City is ordered to provide Mr. Calhoun with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Calhoun may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
