The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 8, 2024 SPR24/2756 Stephanie Welch Executive Assistant Westminster Police Department 7 South Street Westminster, MA 01473 Dear Ms. Welch: On October 4, 2024, this office received your petition on behalf of the Westminster Police Department (Department) requesting permission to charge for time spent segregating or redacting responsive records and seeking a waiver of statutory limits to fees that may be assessed in responding to the request. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Department furnished a copy of the petition to the requestor, De Silva. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On September 23, 2024, De Silva requested “…[a]ll materials, records, reports, documents, audios, videos for the following [identified individuals]...” Subsequently, in an email to the Department on October 4, 2024, De Silva states “I agree to the fee quoted.” In light of the above, it is unnecessary to opine on the Department’s petition to charge for time spent segregating or redacting responsive records.
