Assistant City Solicitor City of Worcester Law Department 51 Sever Street Worcester, MA 01609 Dear Attorney Thompson: I have received the petition of Tom Marino, of This Week In Worcester, appealing the response of the City of Worcester (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 27, 2024, Mr. Marino requested, “data relevant to Restraining Orders/ Abuse Prevent Orders (209A orders) and Harassment Prevention Orders (258E orders) assigned to the Worcester Police Department… I request the data include the following, if available”: [1.] Any document number (excluding parties) [2.] Type of order (209A or 258E) [3.] Date of issuance [4.] Date of expiration [5.] Issuing Court [6.] Date of service by the Worcester Police Department [7.] Number of attempts of service by Worcester Police Department Any other available data, excluding identifying data for any plaintiff or defendant[.] Previous Appeal This request was the subject of a previous appeal. See SPR24/2362 Determination of the Supervisor of Records (September 5, 2024). In my September 5th Determination, I learned that the City intended to provide Mr. Marino with a response. The City responded on October 9, 2024). Unsatisfied with the City’s response, Mr. Marino petitioned this office and this appeal, SPR24/2804, was opened as a result.
