Box 466 Gardner, MA 01440 Dear Ms. Melanson: I have received the petition of Robert Cantell appealing the response of the North Central Correctional Institution (Institution) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 3, 2024, Mr. Cantell requested the following: All IPS Evidence Custody Forms (Attachment D) completed pursuant to 103 DOC 506.12 C.6 for the month of [1] ... February 1-29, 2024 [2] ... March 1-31, 2024 [3] ... April 1-30, 2024 The Institution responded on October 4, 2024, denying the request, and citing the Criminal Offender Records Information (CORI) statute for withholding responsive records. See G. L. c. 6, § 167. Unsatisfied with the Institution’s response, Mr. Cantell petitioned this office, and this appeal, SPR24/2811, was opened as a result. Subsequent to the opening of this appeal, in a letter to this office and the Institution on October 17, 2024, Mr. Cantell states the following: I have received a somewhat satisfactory response to my request, and would accordingly like to withdraw my request for records per the afore referenced case number. In light of Mr. Cantell’s October 17th letter, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. Cantell may further appeal the substantive nature of the Institution’s most recent response within ninety (90) days. See 950 C.M.R. 32.08(1).
