The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 22, 2024 SPR24/2813; SPR24/2814; Allison Mondello Public Records Manager Massachusetts Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petitions of Attorney Michael Leung-Tat appealing the nonresponses of the Department of State Police (Department) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 20, 2024 and September 23, 2024, Attorney Leung-Tat requested the following records: [1] All towing logs for all Massachusetts highways between July 1, 2018 and July 1, 2024, including: Time and date of request for a vehicle tow, location of the requested tow, time and date of tow truck’s arrival on scene, time and date of the tow truck’s clearance of the scene, time and date of the release of State Police presence at the scene, tow company called[;] [2] Blank copies of all documents that the Massachusetts State Police requests or requires new employees and State Police Academy recruits to execute, sign, acknowledge or otherwise, including a copy of all policies to which new employees, including State Police Academy recruits, are subject. Claiming to not yet have received responsive records, Attorney Leung-Tat petitioned this office and the following appeals, SPR24/2813 and SPR24/2814, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Leung-Tat with a response to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Leung-Tat may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
