See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 27, 2024, Ms. Bennett requested the following: [1] All complaints received by the Town regarding . . . South Maple St., particularly in relation to [an identified individual], including any written, electronic, or verbal records of complaints filed or reported within the last six months [2] Any emails, written letters, texts, or other forms of communication between the Board of Health and the Zoning Enforcement Officer related to . . . South Maple St. or [an identified individual] [3] Any communications—electronic, written, or otherwise—that were exchanged between any department, board, official, or town employee and the Zoning Enforcement Officer regarding . . . South Maple St. or the new violation issued to [an identified individual]. Claiming to not yet have received responsive records, Ms. Bennett petitioned this office and this appeal, SPR24/2829, was opened as a result. Subsequently, I learned that the Town provided Ms. Bennett with a response on October 15, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Ms. Bennett may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
