Assistant Vice Chancellor for Management University of Massachusetts Chan Medical School 55 Lake Avenue North Worcester, MA 01655 Dear Mr. Menard: I have received the petition of Attorney Michaela Roberta Martin Strout, of Committee for Public Counsel Services, appealing the nonresponse of the University of Massachusetts Chan Medical School (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 2, 2024, Attorney Strout requested the following records: [1] Any updates or amendments to the University of Massachusetts Fair Information Practices Regulations policy (Document T77-059, produced in response to CPCS Strategic Litigation Unit public records request dated 7/19/2024) since its effective date of 2/2/1977[;] [2] All documents, policies, and procedures regarding the specific procedure by which a data subject may request access to their personal data pursuant to §§ 304 and 305 of the University of Massachusetts Fair Information Practices Regulations policy (Document T77-059)[;] [3] Any records identifying the current designated personal data management officer, as required by §§ 202 and 312 of the University of Massachusetts Fair Information Practices Regulation Policy (Document T77-059). Claiming to not yet have received responsive records, Attorney Strout petitioned this office and this appeal, SPR24/2858, was opened as a result. Subsequently, I learned that the School provided a response to Attorney Strout on October 25, 2024. Where this appeal was opened as a result of the School’s lack of a written response, I will now consider this administrative appeal closed. Attorney Strout may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
