The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 1, 2024 SPR24/2877 Jeannette Meredith Administrative Aide Office of the Town Manager Town of Saugus 298 Central Street Saugus, MA 01906 Dear Ms. Meredith: I have received the petition of Eric J. Heideman appealing the response of the Town of Saugus (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 12, 2024, Mr. Heideman requested “… a copy of the original agreement that was amended in 2020 and would have been between JRM Hauling and Recycling Services, Inc. and the Town of Saugus.” Prior Appeal This request was the subject of a prior appeal. See SPR24/2709 Determination of the Supervisor of Records (October 10, 2024). In my October 10th determination, I found that Mr. Heideman had not asserted a violation of G. L. c. 66, § 10 in his petition. Having received no substantive response to his request by the statutory deadline, Mr. Heideman petitioned this office and this appeal, SPR24/2877, was opened as a result. It is my understanding that the Town intends on providing a further response to Mr. Heideman. Accordingly, the Town is ordered to provide Mr. Heideman with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Heideman may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
