Assistant General Counsel Boston Public Health Commission 1010 Massachusetts Avenue Boston, MA 02118 Dear Attorney Salas: I have received the petition of Friedrich Lu appealing the response of the Boston Public Health Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 11, 2024, Mr. Lu requested: [1] record indicating full name of [an identified individual][;] [2] work schedule (in the form of a grill) of the 3 to 11 pm shift, Oct 10. The schedule assigns two to sit at the check-in desk at (almost) all times. Please indicate who sits where OR who assigns bed or mats in the check-in desk[;] [3] A list of guests sent to Engagement center last night [October 10]. The Commission provided a response on October 11, 2024. Unsatisfied with the response, Mr. Lu petitioned this office and this appeal, SPR24/2949, was opened as a result. It is my understanding that the Commission intends on providing a further response to Mr. Lu. Accordingly, the Commission is ordered to provide Mr. Lu with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Lu may appeal the substantive nature of the Commission’s response within ninety days. See 950 C.M.R. 32.08(1).
