The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 4, 2024 SPR24/2955 Lesley Moreau Records Access Office Executive Office of Elder Affairs One Ashburton Place, Room 517 Boston, MA 02108 Dear Ms. Moreau: I have received the petition of Peter Tiernan appealing the response of the Executive Office of Elder Affairs (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 10, 2024, Mr. Tiernan requested the following information: [1] For the most recent service month that is reasonably viewed as financially closed, the statewide count of billable units of service type “Home Care Program Services Direct Services” as established by 101 CMR 417.03(4); [2] For the FY24 service months of July 2023 through June 2024, the statewide count of billable units of service type “Home Care Program Services Direct Services” as established by 101 CMR 417.03(4); [3] For the most recent service month that is reasonably viewed as financially closed, the statewide count of billable units of service type “Enhanced Community Options Program (ECOP) Direct Services” as established by 101 CMR 417.03(4); [4] For the FY24 service months of July 2023 through June 2024, the statewide count of billable units of service type “Enhanced Community Options Program (ECOP) Direct Services” as established by 101 CMR 417.03(4). The Office responded on October 28, 2024. Unsatisfied with the Office’s response, Mr. Tiernan petitioned this office and this appeal, SPR24/2955, was opened as a result. Subsequently, I learned that the Office provided a further response to Mr. Tiernan on November 4, 2024. Where this appeal was opened as a result of the Office’s October 28, 2024 response, I will now consider this administrative appeal closed. Mr. Tiernan may appeal the substantive nature of the Office’s November 4th response within ninety (90) days. See 950 C.M.R. 32.08(1).
