See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 4, 2024, Mr. Sakach requested “a copy of the application for a septic system permit, as referenced in the June 4 2024 Board of Health meeting minutes: ‘The Board looked at the South Shore Drive application for an upgrade/replacement.’” Claiming to not yet have received responsive records, Mr. Sakach petitioned this office and this appeal, SPR24/2996, was opened as a result. Subsequently, I learned that the Town provided Mr. Sakach with a response on November 5, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Sakach may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
