The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 14, 2024 SPR24/3002 Kate Silvia Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Randy Arias appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 4, 2024, Mr. Arias requested the following records: [1] Any report(s) of any and all asbestos discoveries located within MCI-Norfolk within the months of January 2024 to October of 2024[;] [2] A list of housing units where the asbestos was found within the months of January of 2024 through October of 2024[;] [3] Evidence that an asbestos abatement was conducted in the year of 2024[;] [4] The name of the company that came to MCI-Norfolk to conduct the abatement process in the year 2024[;] [5] An estimate of how may incarcerated individuals were exposed to the asbestos[;] [6] Any and all report(s) of asbestos tests conducted throughout the MCI-Norfolk housing units and facility. Claiming to not yet have received responsive records, Mr. Arias petitioned this office and this appeal, SPR24/3002, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response.
