Paradis Records/Property Supervisor Barnstable Police Department 1200 Phinneys Lane Hyannis, MA 02601 Dear Ms. Paradis: I have received the petition of Todd Wallack, of WBUR, appealing the response of the Barnstable Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 2, 2024, Mr. Wallack requested, “[a]ny complaints filed with the department over the way the department or an individual officer handled a case or report involving sexual assault, including indecent assault, rape and attempted rape since Jan. 1, 2018.” The Department responded on November 5, 2024. Unsatisfied with the response, Mr. Wallack petitioned this office and this appeal, SPR24/3012, was opened as a result. It is my understanding that the Department intends on providing a further response to Mr. Wallack. Accordingly, the Department is ordered to provide Mr. Wallack with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Wallack may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
