The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 25, 2024 SPR24/3104 Romina Moniz City of New Bedford Office of the City Solicitor 133 William Street, Room 203 New Bedford, MA 02740 Dear Ms. Moniz: I have received the petition of John M. Gallagher, Esq. appealing the nonresponse of the City of New Bedford (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 28, 2024, Attorney Gallagher requested, “[a]ny and all documents regarding alterations, additions, repairs, or improvements to the property known as the Roberson House, … William Street, New Bedford, Massachusetts pursuant to Covenant between the City of New Bedford and [a named individual] dated March 21, 2001 and recorded on April 17, 2001 at the Bristol County Registry of Deeds, Book 049621 at page 52.” Claiming to not yet have received responsive records, Attorney Gallagher petitioned this office and this appeal, SPR24/3104, was opened as a result. Subsequently, I learned that the City provided Attorney Gallagher with a response on November 14, 2024. Where this appeal was opened as a result of the CIty’s lack of a written response, I will now consider this administrative appeal closed. Attorney Gallagher may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Manza Arthur Supervisor of Records cc: John M. Gallagher, Esq.
