See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 24, 2024, Ms. Grant requested the following: [C]opies of public records that pertain to the shooting death of . . . [an identified individual] on 10/04/2012 at or near . . . Wales St in Taunton MA 02780. To include investigative notes, witness interviews, diagrams, and documents gathered in the course of the investigation. . . . I would also like [a] copy of [an identified Office representative’s] final report. . . . On November 5, 2024, the Office responded and provided a fee estimate of $87.50. In support of the fee estimate, the Office explained that it would take an estimated 7.5 hours in order to comply with the request and that it would not charge for the first four hours of work. See G. L. c. 66, § 10(d)(ii). The Office further advised, “the remaining 3.5 hours are assessed at $25 per hour, requiring a fee of $87.50 before the work can be completed.” Subsequently, in an email to the Office on the same date, Ms. Grant modified her request and stated, “[p]lease complete four hours of free redactions and provide what documents are completed during that four-hour period. I absolutely want any of the officer(s) [sic] . . . statements included in the documents you work on in that four hour period.” The Office responded to the modified request on November 19, 2024. Unsatisfied with the Office’s response, Ms. Grant petitioned this office and this appeal, SPR24/3136, was opened as a result. Subsequent to the opening of this appeal, I learned that the Office provided a supplemental response by email to Ms. Grant and this office on November 21, 2024.
