The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 21, 2024 SPR24/3151 Amanda Williams Records Clerk Brookline Police Department 350 Washington Street Brookline, MA 02445 Dear Ms. Williams: On November 21, 2024, this office received your petition on behalf of the Brookline Police Department (Department) seeking a waiver of statutory limits on fees that may be assessed in responding to the request. G. L. c. 66, § 10(d)(iv). As required by law, it is my understanding that the Department furnished a copy of the petition to the requestor, Attorney Felix Arroyo. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On November 7, 2024, Attorney Arroyo requested: [1.] [A] copy of the [specified] police report [;] [2.] [A]ny traffic camera footage showing the [identified] accident [;] [3.] [A]ny body camera footage from when the officers arrived at the scene until they left [.] On November 21, 2024, Attorney Arroyo emailed the Department and this office, and stated, “[c]an I put a hold on this request until I get the police report and traffic cam footage of the accident (if there is one)?” Conclusion In light of the decision to modify the scope of the request, I find it is unnecessary to opine on the Department’s fee petition at this time. I encourage Attorney Arroyo and the Department to continue to communicate directly in order to facilitate producing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
