Associate General Counsel Executive Office of Energy & Environmental Affairs 100 Cambridge Street, Suite 900 Boston, MA 02114 Dear Attorney Moore: On November 27, 2024, this office received your petition on behalf of the Executive Office of Energy & Environmental Affairs (Office/EEA) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Office furnished a copy of the petition to the requestor, Andre Queiroga. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On November 14, 2024, Mr. Queiroga requested, “[a]nything included but not limited to, search and rescue calls, (SAR), recoveries, sexual incident involving minor child at Lowell pool from the summer of 2016.” Subsequently, in an email to the Department on December 3, 2024, Attorney Leigh Panettiere, on behalf of Mr. Queiroga, states “we need an opportunity to narrow the request. We appreciate the EEA’s response, but we ask that EEA not attempt to prepare the documents yet, so that the fees do not add up as projected in the letter.” In light of the above, it is unnecessary to opine on the Office’s petition to charge for segregating or redacting responsive records.
