See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In two separate requests, on September 17, 2024 and September 18, 2024, Mr. Johnson requested the following: SPR24/3252 [1] Any records during what periods of time [an identified individual] was serving in an official capacity as a member of BPD’s Internal Investigations Unit or Internal Affairs Division (“IAD”); [2] A copy of at least one report written and/or signed by [an identified individual] during a time when [an identified individual] was a member of IAD, in which a complaint of misconduct was made by a United States citizen against a Boston Police officer was sustained; and [3] Any records showing [an identified individual]’s involvement with [an identified individual] being “exonerated” by IAD. SPR24/3252; SPR24/3253 Page 2 December 12, 2024 Department of the City of Boston (“BPD”)) arising out of the vicious beating [of an identified individual] received from [an identified individual]’s BPD co- worker’s in January 1995; [2] A copy of any written Settlement Agreement [an identified individual] entered into with the City of Boston arising out of the vicious beating [of an identified individual] received as a result of [an identified individual]’s BPD co-worker’s criminal acts of brutality in January 1995; and [3] A copy of any check(s) made payable to [an identified individual] or [an identified individual]’s legal representative, as monetary compensation or otherwise, for the vicious police brutality [an identified individual] endured in January 1995 at the hands (and feet) of [an identified individual]’s BPD co- worker’s, none of whom have ever faced charges based upon the violence - - - as a direct result of BPD’s pattern and practice of covering-up BPD’s systematic violations of State and Federal law (18 U.S.C. § 241) - - - rooted in BPD’s longstanding and unconstitutional Blue Wall of Silence. The City’s assigned reference number is B003154-110124 for SPR24/3252. For SPR24/3253, the assigned reference number is R003797-091924. Claiming to not yet have received responsive records, Mr. Johnson petitioned this office and the following appeals, SPR24/3252 and SPR24/3253, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the City has provided a response(s). Accordingly, the City is ordered to provide Mr. Johnson with a response(s) to his requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response(s) must be provided to this office. It is preferable to send an electronic copy of the response(s) to this office at pre@sec.state.ma.us.
