The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 11, 2024 SPR24/3275 Janell Summers Records Access Officer Malden Public Schools 110 Pleasant Street Malden, MA 02148 Dear Ms. Summers: On December 5, 2024, this office received your petition on behalf of the Malden Public Schools (School) seeking an extension of time and permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the School furnished a copy of the petition to the requestor, Brian Delacey, of Malden News Network. G. L. c. 66, § 10(c); G. L.c. 66, § 10(d)(iv)(2). On November 20, 2024 Mr. DeLacey requested the following records: 1. Please provide any policy, guidance, direction, or notice promulgated to school or City staff - in any of their capacities - related to photography and video collection in MPS activities. 2. Additionally please provide the following: 3. Blank versions of “Photograph and Video Release Form” used by MPS for school years 2022-2023 and 2023-2024 and 2024-2025 4. Any written analysis or review of the “Consent and Photo/Video Release Form” used by DESE 5. Any written review or comparison of Malden’s “Release Form” compared to that used by DESE 6. Any spreadsheet or document of any kind providing any quantitative, metric, record, analysis or tabular summary derived from MPS use of such “Release Forms” for EACH OF THE THREE identified school years: a. number of students for whom a signed form was expected (assume one form per student: expect adjusted data for multiple students with only one Parent/Guardian signature) b. number of signed response forms actually received for the given school year c. number of CHECKS indicating permission approved (with no qualifications or restrictions) to use name/picture [opt-in] … One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Janell Summers SPR24/3275 Page 2 December 11, 2024 d. number of CHECKS for qualified or permission denied (or qualified) to use name/picture e. number of signed forms with no response given whether to use name/picture f. number of CHECKS for permission approved (with no qualifications or restrictions to use network etc g. number of CHECKS for qualified or permission denied to use network etc. h. number of signed forms with no response given whether to approve network use etc. i. number of students for whom no signed form was received j. Any images used by MPS for “on the school website” or “in any media action that pertains to the Malden Public Schools” which were covered by these Release Forms. Subsequently, in an email to the School on December 5, 2024, Mr. DeLacey states “[w]e will submit a simpler, streamlined request in lieu of this request, in the hope of saving working effort for all parties involved.” In light of the above, it is unnecessary to opine on the School’s petition at this time.
