Assistant General Counsel Records Access Officer Department of Children and Families McCormack Building 1 Ashburton Place, 3rd Floor Boston, MA 02108 Dear Attorney Treat: I have received the petition of Scooty Nickerson, of the Boston Globe, appealing the response of the Department of Children and Families (Department/DCF) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 30, 2024, Mr. Nickerson requested the following records: [1] How many unique missing DCF foster children were screened as a possible sex trafficking victim, by year, from 2016 to the present date. [2] How many unique missing DCF foster children were determined to be a possible or likely sex trafficking victim, from 2016 to the present date. The Department responded on October 30, 2024 and November 25, 2024. Unsatisfied with the Department’s responses Mr. Nickerson petitioned this office and this appeal, SPR24/3281, was opened as a result. Subsequently, I learned that the Department provided Mr. Nickerson with a response on December 16, 2024, in which the Department stated, “DCF intends to send you the remaining data you requested going back to 2016 as per your public records request.” Where this appeal was opened as a result of the Department’s October 30, 2024 and November 25, 2024 responses, I will now consider this administrative appeal closed. Mr. Nickerson may appeal the substantive nature of the Department’s December 16th response within ninety (90) days. See 950 C.M.R. 32.08(1).
