The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 16, 2024 SPR24/3310; SPR24/3312 Allison Mondello Public Records Manager Massachusetts Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petitions of Danielle Makosky appealing the nonresponses of the Massachusetts Department of State Police (Department) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In two (2) separate requests on September 14, 2024 and October 24, 2024, Ms. Makosky requested the following records: [1] Dash cam video on 9/14/2024 from 12pm until 5pm, including the time the above referenced citation was issued. Any other written documentation related to the above referenced citation and any department policies available to the public[;] [2] Dashcam video and body cam footage (body cam footage if available to the public/individual) on 9/14/2024 from 12pm until 5pm, including when the above- referenced citation was issued. Any other written documentation related to the above-referenced citation and any department policies available to the public. Claiming to not yet have received responsive records, Ms. Makosky petitioned this office and the following appeals, SPR24/3310 and SPR24/3312, were opened as a result. Despite being notified of the opening of both appeals, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Ms. Makosky with a response to her requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Makosky may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
