Assistant General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3150 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Joseph N. Schneiderman, Esq. appealing the nonresponse of the Massachusetts Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 15, 2024 Attorney Schneiderman requested the following: [1] All cases, case indices, dockets, or matters where [an identified individual] represented a party before your agency between 1989 and 2004, including but not limited to before the Board of Appeal on Motor Vehicle Policy Liability Policies and Bonds; [2] Any cases, case indices, dockets or matters involving [an identified individual] also between 1989 and 2004, including but not limited to before the Board of Appeal on Motor Vehicle Policy Liability Policies and Bonds; and [3] Any cases, case indices, dockets, or matters involving [an identified individual] where [an identified individual] represented [an identified individual] between 1989 and 2004, including but not limited to before the Board of Appeal on Motor Vehicle Policy Liability Policies and Bonds. Claiming to not yet have received responsive records, Attorney Schneiderman petitioned this office and this appeal, SPR24/3314, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Schneiderman with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days.
