Johnson appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 12, 2024, Mr. Johnson requested: [T]he names and positions of the decision makers for changes to the MSP Towing Contracts for upcoming contracts and the reports, supporting documents and emails submitted to those decision makers regarding suggested changes as well as the reports containing the Tow Service Provider’s (TSP) and Statewide Towing Association’s (STA) input and issues. Note: At TSP Focus Group meetings with TSP’s and STA, the MSP Tow Compliance Unit and their consultant have stated they are not the final decision makers regarding changes to the contract. They are only collecting input and reporting to the decision makers. Claiming to not yet have received responsive records, Mr. Johnson petitioned this office and this appeal, SPR24/0537, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Johnson with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Johnson may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
