Galvin Town Clerk Town of Milton 525 Canton Avenue Milton, MA 02186 Dear Ms. Galvin: I have received the petition of Phillip Johenning appealing the nonresponse of the Town of Milton to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 27, 2024, Mr. Johenning stated, “I understand from the Special Permit for Landscaping Business Use that Thayer Nursery must present to the Town Engineer on January 1 every year an annual report on the effectiveness of the drainage system at Thayer Nursery. I would like to see copies of those reports for 2020, 2021, 2022, 2023 and 2024.” Claiming to not yet have received responsive records, Mr. Johenning petitioned this office and this appeal, SPR24/3393, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Mr. Johenning with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Johenning may appeal the substantive nature of Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
