Kelleher Records Access Officer Walpole Police Department 50 South Street Walpole, MA 02081 Dear Chief Kelleher: On December 24, 2024, this office received your petition on behalf of the Walpole Police Department (Department) seeking an extension of time to produce records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Department furnished a copy of the petition to the requestor, Ronald Baroni. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On December 19, 2024, Mr. Baroni requested the following: 1. Any and all agreements (or other documents substantially similar in form or function to the attached example Memorandum of Understanding) between the Walpole Police Department and Blessed Sacrament School setting forth the partnership between those two parties as it pertains to the assignment, provision, scope of duties, and operating parameters of a School Resource Officer (SRO). The relevant time periods for this request are: a. The agreement that would have been in effect during May of 2024. b. The agreement that is in effect as of the date of this request, if different from 1(a) above[;] 2. Any and all communications or records (including, but not limited to memos, emails, phone records, phone recordings, meeting invitations, meeting agendas, and meeting notes) between [an identified individual] (or any other Walpole Police official functioning in a substantially similar capacity) and the administration of Blessed Sacrament School (as defined by, but not limited to [identified individuals] pertaining to past inquiries, investigations, referrals, or the provision of formal or informal advice on any matter in which the School Resource Officer became involved in any capacity (as distinct from materials pertaining to on-going investigations or prosecutions, which are recognized exemptions under G.L. c. 4, § 7(26)(f)), and as distinct from materials pertaining One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

This scope of this request is to include both matters in which the School Resource Officer was involved under the scope of the prevailing agreement between the Walpole Police Department and Blessed Sacrament School at the time, or any matters that did not fall under such scope. The relevant time period of this request is January 1, 2024 through the date of this request[.] Subsequently, in an email to the Department on December 24, 2024, Mr. Baroni states “[n]o issues with an extension from my perspective. I would also be happy to discuss ways that we can narrow the scope of my request if it makes this easier for all concerned, as I have no interest in creating unnecessary work for the town or Police Department.” In light of the above, it is unnecessary to opine on the Department’s petition seeking an extension of time to produce records.
