The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 7, 2025 SPR24/3430 Haley Meczywor Town Clerk Town of Adams 9 Park Street Adams, MA 01220 Dear Ms. Meczywor: I have received the petition of Kathy Foley appealing the response of the Town of Adams (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 28, 2024, Ms. Foley requested, “a copy of all written documents, including but not limited to emails, texts messages, notes, memos and any other documents and correspondence regarding me, my business of Aisling Mountain Farm or my property at [a specified address]. This includes those within and among town employees, elected officials and appointed and volunteer workers for the town as well as to and from outside persons or entities.” On November 12, 2024, the Town responded, providing records. On November 13, 2024, in response to the November 12th response, Ms. Foley expanded her request and stated, “[u]nfortunately, what [the Town] sent yesterday is only a portion of the requested records (not including those of prior owners’ building files). I refer you back to the original request dated 10/28/24…” On November 27, 2024, the Town responded, providing a fee estimate. Unsatisfied with the Town’s response, Ms. Foley petitioned this office and this appeal, SPR24/3430, was opened as a result. Subsequently, I learned that the Town provided a further response on January 7, 2025. Where this appeal was opened as a result of the Town’s November 27th response, I will now consider this administrative appeal closed. Ms. Foley may appeal the substantive nature of the Town’s January 7th response within ninety (90) days. See 950 C.M.R. 32.08(1).
