The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 3, 2025 SPR24/3434 Jacqueline Cook Keeper of Records Lowell Police Department 50 Arcand Drive Lowell, MA 01852 Dear Ms. Cook: I have received the petition of Concerned Parents appealing the nonresponse of the Lowell Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 4, 2024, the requestor sought the following records: [1] Copy of any statistical and data records that show total number of officers employed and on active duty as well as indicates if with a specialty unit (example criminal, gang, task force etc.) or not, for the following months: January 2024, March 2024, May 2024, July 2024, September 2024, November 2024[;] [2] Copy of any statistical and data records that show total number of officers not employed and placed on un-active duty due to: injuries, training, personal or retirement as well as indicates if that officer was from a specialty unit (example criminal, gang, taskforce etc.) or not, for the following months: January 2024, March 2024, May 2024, July 2024, September 2024, November 2024[;] [3] Copy of any statistical and data records that show total number of officers hired and their first day of employment with Lowell Police as well as indicates if that officer was from a specialty unit (example criminal, gang, taskforce etc.) or not, for the following months: January 2024, March 2024, May 2024, July 2024, September 2024, November 2024[;] [4] Copy of any policy or other related to how many officers are assigned to ride in the same patrol car as well as what areas of Lowell that more than one officer was assigned in the same patrol car, and that would be responsive to what shift hours for this type of patrol practice for the following months: January 2024 – One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Porter SPR24/3433 Page 2 January 3, 2025 December 2024 (if this policy or practice was implemented prior to these date months and there’s a record responsive, then we would like a copy). Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR24/3434, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide the requestor with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
