City Solicitor City of Everett 484 Broadway, Room 10 Everett, MA 02149 Dear Attorney Mejia: I have received the petition of Allison Jenkins appealing the nonresponse of the City of Everett (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 4, 2024, Ms. Jenkins requested the following regarding an investigation: [1] Who requested the investigation? [2] What was the charge or reason given for requesting the investigation? [3] Please send me any written documents (allowable) that were supplied in requesting the investigation. [4] Please send me any forms, notes, documents etc. placed in or will be placed in my personnel file relative to the investigation. Claiming to not yet have received responsive records, Ms. Jenkins petitioned this office and this appeal, SPR24/3439, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the City has provided a response. Accordingly, the City is ordered to provide Ms. Jenkins with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Jenkins may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
