The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 13, 2025 SPR24/3446 Nancy Talbot Town Clerk Town of Ware 126 Main Street, Suite B Ware, MA 01082 Dear Ms. Talbot: I have received the petition of Cynthia Allen appealing the response of the Town of Ware (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 4, 2024, Ms. Allen requested, “…copies of anything the [Town’s] lawyer has concerning Mary Lane Hospital since 2021. That is after the [Board of Selectmen (Board)] have reviewed the documents and determined nothing is confidential.” The Town provided responses on October 9, 2024 and December 17, 2024. Unsatisfied with the Town’s responses, Ms. Allen petitioned this office and this appeal, SPR24/3446, was opened as a result. Based on an email correspondence to this office on January 10, 2025, it is my understanding that the Town intends to provide Ms. Allen with a further response. Accordingly, the Town is ordered to provide said response in a manner consistent with the Public Records Law and its Regulations within ten business days. A copy of any response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Ms. Allen may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
