The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 13, 2025 SPR25/0010 Rachel Cohen Records Access Officer Massachusetts Department of Environmental Protection 1 Winter Street Boston, MA 02108 Dear Ms. Cohen: I have received the petition of Kevin Mullen appealing the nonresponse of the Massachusetts Department of Environmental Protection (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 5, 2024, Mr. Mullen requested records regarding a wetland violation: [1] all documents, photographs, staff reports, etc., in whole or in part, related to this event, including, but not limited to the request and the ultimate decision[;] [2] I am seeking communications between the agencies, whether written or electronic, from the time period related to the request and the final decision. Claiming to not yet have received responsive records, Mr. Mullen petitioned this office and this appeal, SPR25/0010, was opened as a result. Subsequently, I learned that the Department provided Mr. Mullen with a response on October 17, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Mullen may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
