The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 7, 2025 SPR25/0027 Amanda Williams Records Clerk Brookline Police Department 350 Washington Street Brookline, MA 02445 Dear Ms. Williams: On January 3, 2025, this office received your petition on behalf of the Brookline Police Department (Department) seeking permission to waive statutory limits to fees and to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Department furnished a copy of the petition to the requestor, Erica Jorgensen, of NBC10 Boston. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On December 31, 2024, Ms. Jorgensen requested “[a] database of any and all internal affairs investigations/complaints for all police officers from 2014 – Present. Please include, but do not limit it to the following fields of data: Case number/IA number/File No, Incident Type, Date it was received/opened, Date it was closed, Officer First/Middle and Last Name, Officer Rank/Title and the final disposition.” Subsequently, in an email to this Office on January 7, 2025, the Department stated, “[w]e are not going to pursue this fee petition at this time, and will consider this request closed.” Conclusion In light of the above, I find it is unnecessary to opine on the Department’s fee petition at this time. I encourage Ms. Jorgensen and the Department to continue to communicate directly in order to facilitate producing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
