Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 I have received petition of Matthew Vasquez appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 2, 2025, Mr. Vasquez requested the following records: [1] All records regarding the failure of the escalator (MBTA # 142) at Back Bay Sta[tion] September 26, 2021. [2] All video recordings that show the escalator (MBTA#142) at Back Bay Station on September 26, 2021. [3] All records regarding the maintenance of escalators at Back Bay station… [4] All email from and/to Kone, Inc. regarding the maintenance of escalator Station (MBTA#142) at Back Bay Station. [5] All email from and to Kone, Inc. regarding the failure of the escalator Back Bay station from 2019 to 2022. [6] All email from and to Kone, Inc. regarding the inspection, maintenance escalator (#142) that failed at Back Bay station on September 26, 2021. The MBTA responded on January 7, 2025. Unsatisfied with the MBTA’s response, Mr. Vasquez petitioned this office and this appeal, SPR25/0066, was opened as a result. It is my understanding that the MBTA intends on providing a further response to Mr. Vasquez to address the records request. Accordingly, the MBTA is ordered to provide Mr. Vasquez with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Vasquez may appeal the substantive nature of the MBTA’s response within ninety days. See 950 C.M.R. 32.08(1).
