Devito Police Sergeant Records & Scheduling Billerica Police Department 6 Good Street Billerica, MA 01821 Dear Sergeant Devito: I have received the petition of Douglas Dunphy appealing the response of the Billerica Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 3, 2025, Mr. Dunphy requested, “police incident reports that may involve [named individuals].” The Department responded on January 8, 2025. Unsatisfied with the response, Mr. Dunphy petitioned this office and this appeal, SPR25/0077, was opened as a result. Subsequently, I learned that the Department provided a further response on January 10, 2025. Where this appeal was opened as a result of the Department’s January 8th response, I will now consider this administrative appeal closed. Mr. Dunphy may appeal the substantive nature of the Department’s January 10th response within ninety (90) days. See 950 C.M.R. 32.08(1).
