Frayler Administrative Lieutenant Swampscott Police Department 531 Humphrey Street Swampscott, MA 01907 Dear Lieutenant Frayler: I have received the petition of Kelly Walker appealing the response of the Swampscott Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 11, 2024, Ms. Walker requested, “all records, including without limitation body camera footage, relating to the automobile accident responded to by Swampscott Police Department and Fire Department on November 16, 2024 at approximately 4:45 pm at or near [a specified address], Swampscott, Massachusetts.” Prior Appeal This request was the subject of a prior appeal. See SPR25/0081 Determination of the Supervisor of Records (January 17, 2025). In my January 17th determination, I learned that the Department provided a further response on January 10, 2025, including records. Unsatisfied with the response, Ms. Walker petitioned this office and this appeal, SPR25/0166, was opened as a result. It is my understanding that the Town intends on providing a further response to Ms. Walker to address her records request. Accordingly, the Town is ordered to provide Ms. Walker with said response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
