Records Access Officer Berkshire District Attorney’s Office 7 North Street Pittsfield, MA 01201 Dear Attorney Pieropan: I have received the petition of Elise Lambert, of the Committee for Public Counsel Services, appealing the nonresponse of the Berkshire District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 18, 2024, Ms. Lambert requested: [1] Any policies and procedures regarding requesting documents the DOC sends to District Attorneys’ Offices when notifying them under G. L. c. 123A, § 12. [2] Any letters that your office has sent to DOC in the past two months seeking information and/or documentation to inform a determination under G. L. c. 123A, § 12. Claiming to not yet have received responsive records, Ms. Lambert petitioned this office and this appeal, SPR25/0172, was opened as a result. Subsequently, I learned that the Office provided Ms. Lambert with a response on January 22, 2025. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Ms. Lambert may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
