See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 10, 2025, Ms. Misselli requested the following records: [1] Any incident report, arrest report, affidavits, or other documents related to [an identified individual] from the time period of 1996-2004[;] [2] Copies of any police reports or other records in your possession pertaining to felony assault and battery charges that resulted in the filing of [a named] Chelsea District Court Case[.] Claiming to not yet have received responsive records, Ms. Misselli petitioned this office and this appeal, SPR25/0269, was opened as a result. Subsequently, I learned that the Department provided Ms. Misselli with a response on January 29, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Misselli may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
