The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 31, 2025 SPR25/0279 Ellen Sachs Leicher Chair Climate Initiative Committee Town of Harvard 13 Ayer Road Harvard, MA 01451 Dear Chair Leicher: I have received the petition of Deborah Skauen-Hinchliffe appealing the response of the Town of Harvard (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 13, 2025, Ms. Skauen-Hinchliffe requested, “[any] and all documents and correspondence concerning the HCIC’s proposed tree bylaw(s) and regulations between the dates 7 January 2025 and 13 January 2025 between and among any and all members of Harvard Climate Initiative Committee. Please also provide, by email, with the tree bylaw(s) and regulations that were proposed to HCIC by the consultant provided by the MVP grant.” Prior Appeal This request was the subject of a prior appeal. See SPR25/0271 Determination of the Supervisor of Records (January 30, 2025). In my January 30th determination, I found that the Town had provided Ms. Skauen-Hinchliffe with a response on January 30, 2025. Unsatisfied with the Town’s January 30th response, Ms. Skauen-Hinchliffe petitioned this office and this appeal, SPR25/0279, was opened as a result. It is my understanding that the Town intends to provide a further response to Ms. Skauen- Hinchliffe. Accordingly, the Town is ordered to provide Ms. Skauen-Hinchliffe with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Skauen-Hinchliffe may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
