The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 3, 2025 SPR25/0292 Kathleen Wang Principal Pioneer Valley Chinese Immersion Charter School 317 Russell Street Hadley, MA 01035 Dear Principal Wang: I have received the petition of Michael Klein appealing the nonresponse of the Pioneer Valley Chinese Immersion Charter School (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 8, 2025, Mr. Klein requested copies of the School’s parent surveys for the years 2015, 2016, and 2017. Prior Appeal A similar request was the subject of prior appeals. See SPR24/3196 Determination of the Supervisor of Records (December 11, 2024) and SPR24/3410 Determination of the Supervisor of Records (January 8, 2025). In my January 8th determination, I found that the School had met its burden to assess a fee of $150.00. Subsequently on January 8, 2025, Mr. Klein modified the scope of his original request. Claiming to not yet have received responsive records, Mr. Klein petitioned this office and this appeal, SPR25/0292, was opened as a result. It is my understanding that the School intends to provide a response to Mr. Klein. Accordingly, the School is ordered to provide Mr. Klein with said response, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Klein may appeal the substantive nature of the School’s response within ninety days. See 950 C.M.R. 32.08(1).
